Truspact Warrants all parts (Special Order items 7 OEM Spare Parts) free from defects in material and workmanship for a period of 60 days from the date of purchase. Our extent of liability is limited to replacement of the defective part. No other warranty is either expressed or implied. No warranty is made against deterioration or corrosion after delivery.
This warranty excludes special order items & OEM spare parts consequential damages indemnifies and holds harmless the Directors, Officers, Agents, Employees, Successors and assigns whether acting in the course of their employment or otherwise, against any law suits, actions or proceedings at law or in Equity from any and all claims, demands, losses, judgements, fines, penalties, damages, costs, expenses or liabilities.
Terms of Sales are net 30days approx. For customers that have established an open account with us. Overdue accounts will be charged a 5% profit for all past due amounts. All new accounts will be C.O.D (Cash on Delivery) until credit has been checked and approved, we will be glad to provide the customer with a credit application upon request. All manufacturers’ part numbers under this catalogue, parts box name & other details are OEM numbers and are for reference purpose only.
All claims for defective merchandise must be submitted in writing to Truspact within 60 days of receipt of merchandise or such claims are waived.
Written authorization must be obtained from Truspact before returning any merchandise. A copy of this return material authorization and a copy of the invoice must accompany the return merchandise. Truspact Group will be the sole judge of whether merchandise is defective. Defective merchandises will be replaced or credited if it is returned within our terms. Non defective merchandise will be subject to a restocking charge. Possession of the Truspact catalogue or use of Truspact website by any person is not to be constrained, as an offer to sell to that person or anyone else.
The item description, part numbers and information in the Truspact Catalogue, Parts box, and website are proprietary. Use of description, part number and other information from Truspact catalogue or website except for ordering supplies will be considered a violation of copyright, and are subject to intellectual property protections.
All orders received by Truspact should meet or exceed a minimum of USD 50. Orders not meeting this requirement will be assessed a service charge to bring the order up to the minimum for onsite delivery.
All items specially ordered for a customer will be considered non-cancellable or exchanged. All special and custom orders will be held to these terms and conditions.
A minimum of 30USD service charge will be added to any order that requires Truspact to deliver the package to the customer or the carrier.
All goods are shipped at buyers risk from our dock. Our responsibility and liability ceases upon delivery of goods in good order to the carrier or customer’s site. All goods should be examined carefully by the buyer before the transportation receipt is signed. If material is received in bad condition, the buyer is required to inform the agent of the transportation company to make a notation of delivery condition on the freight bill and immediately file a damage claim with the delivering carrier. Buyer agrees to not violate any local, state or foreign laws. Truspact will not knowingly sell a product into an end-use application in an embargoed country. By purchasing products from Truspact, buyer asserts that the product will not have an end-use in an embargoed country.
Any instance of an item missing from a package that is not damaged must be reported to Truspact within 24 hours of receipt of shipment from the carrier. If an item is missing from a damaged package, report this loss to the carrier or directly to Truspact.
Pricing is subject to change without notice; all prices at the time of delivery will prevail.
The terms in this order shall apply if the buyer receives and accepts goods and the terms set forth in this order take precedence over any alternative terms in any other document connected with this transaction. The terms in this order shall also apply if the buyer receives and accepts seller’s goods even if delivered under sellers’ contradictory terms.
The foregoing warranty is in lieu of and excludes all other warranties not expressly set forth herein, whether express or implied by operation of law or otherwise, including but not limited to any representation of performance and any implied warranties of title, non-infringement, merchantability or fitness for a particular purpose. No other warranties are authorized on behalf of M/S Truspact unless specifically issued by M/S Truspact. Except for the limited warranty as set forth herein, M/S Truspact disclaims all warranties, express and implied, including warranties of merchantability and fitness for a particular purpose. specifically, no warranty is made against deterioration or corrosion after shipment. Warranty shall not be extended to any compressor that has been subjected to liquid slugging, improper voltage or installation into contaminated systems.
Buyer shall not take recourse to stipulations deviating from the conditions without express written signed agreement.
Six (6) months warranty on motor rewinding work, in cases that M/S Truspact representative inspects and does the rewinding work. Only performance can be shown to the Buyer but installation if done by Buyer’s representative, warranty will not be provided by Truspact in that case.
These electrical devices, generators & transformers would be warranted and informed as per manufacturer’s terms.
Six (6) months warranty or one year’s warranty can be provided depending on the model of the compressor. But in order to have the warranty applicable on the compressor, the customer needs to register warranty by filling up the Startup card and once verified and acknowledged by M/S Truspact, the warranty period starts from there.

In cases where the installation is been done by M/S Truspact representative/technician (which will be chargeable), M/S Truspact agrees to provide warranty as per mentioned herein.

Buyer is responsible for the proper installation of the merchandise. The Equipment should not be modified or altered from its condition from the date of original installation. Truspact equipment is not designed for personal, family, or household purposes, and its sale for such purposes is not intended. In the event the equipment is so used, this warranty shall be null and void, and the equipment shall be deemed to have been sold “AS IS-WHERE IS” without any warranty of any kind, including without limitation any warranty of title, non-infringement, merchant-ability or fitness for a particular purpose.
Buyer is responsible for gauging compressor upon start up based on the factors listed on the Compressor Start Up Card option online created by M/S Truspact, of the compressor being activated. In the event a Compressor Start Up Card is not filled within seven (7) days of compressor activation the warranty may be voided. A filled Compressor Start Up Card is required for merchandise not remanufactured or tested by M/S Truspact.
Buyer is responsible for determining and correcting the cause of the failure of the compressor that the merchandise is replacing.
All compressors re-built & remanufactured by M/S Truspact are tested prior to shipment. Paperwork showing test results shall accompany each compressor built by M/S Truspact. In the event that a compressor is received without testing paperwork, that compressor has not been remanufactured or tested by M/s Truspact and will only be covered by a warranty of six (6) months from the date of shipment, subject to the same terms listed herein. These six (6) months will be guaranteed only in the case of submission of startup card.
The Equipment must be properly maintained and operated in accordance with M/S Truspact’s maintenance and operating procedures. All service, labor and parts must be acquired from M/s Truspact or its authorized service representative for the User’s area.
This warranty is void if failure is a direct result of handling and/or transportation, fire, water, accident, misuse, acts of god(s), attempted repair by unauthorized persons, improper installation, if serial number has been removed or altered, or if unit is used for purpose other than it was originally intended.
Written Authorization must be obtained from M/S Truspact before returning any merchandise. A copy of the Return Material Authorization received from M/S Truspact must accompany the returned merchandise. In the event the Return Material Authorization is not received, the merchandise will be not accepted by M/S Truspact and will be returned to the Buyer. M/S Truspact will be the sole judge of whether merchandise is defective based on a covered condition. Defective merchandise will be replaced for its purchase price credited to buyer if it is returned within our terms. All equipment returned must be in its original factory crate; freight prepaid and must be in the same condition as originally shipped by M/S Truspact. Returns will only be authorized within thirty (30) days of invoice date.
The terms set forth in these Terms and Conditions take precedence over any alternative terms in any other document connected with this transaction. Any conflicting terms will not become a part of the contract for sale. Receipt of the merchandise is the consent to these terms. If the Buyer does not consent, the merchandise must be returned to the Seller immediately.
M/S Truspact reserves the right to change the prices and specifications of the equipment and/or material without notice. Prices are FOB M/S Truspact warehouses. All orders are subject to acceptance by M/S Truspact.
All orders are subject to credit approval. All Invoices not paid within the specified terms will be subject to a 1.5% per month delinquency charge. Buyer agrees to pay all costs of collection including such attorney’s fees as may be allowed by law.
This invoice will include any Federal, State, City or Local taxes, which may apply and are subject thereto.
Requested carrier will be used upon request. M/S Truspact has the right to ship via any responsible carrier if requested carrier is unavailable. Shipping charges are payable by consignee and any claims arising as such charges shall be resolved between the carrier and the consignee. Shipping dates are approximate. M/s Truspact is not responsible for any delays in deliveries that are beyond our control.
Inspect shipment for any damage, before accepting it. If damaged, open and inspect the contents with the carrier. Any damage should be noted and reported on the delivering carrier’s receipts and also forwarded as mail to M/S Truspact. M/S Truspact assumes no responsibility for damages while in transit.
The warranty does not apply to the defects caused by abuse, misuse, negligence accident, alteration, improper installation, failure to comply installation, maintenance instructions, third party repair, modifications inappropriate storage, transportation and force majeure.
If there is concealed damage to the equipment, notify the carrier immediately. Notification should be made verbally as well as in written form. Request an inspection by the shipping company of the damaged equipment. Retain all crating material until inspection has been made.
In the event that the Buyer is not the End User of the merchandise, the Buyer will provide a copy of these Terms and Conditions to the End User prior to installation. Buyer will indemnify and hold harmless M/S Truspact against any loss or liability arising from any claims resulting from the installation of the merchandise.
The aggregate liability, if any in damages or otherwise shall not exceed the purchase price which has been paid to M/S Truspact.
The laws of the United States shall govern this Agreement and the legal relations between the parties without giving effect to any conflict of law provision (whether of United States or any other Jurisdiction) that would cause the application of the law of any other jurisdiction.
NOTE:
If there is a defect in material or factory workmanship covered by this Warranty reported to M/S Truspact during the period the applicable Warranty is in force and effect, M/S Truspact will repair or replace, at M/S Truspact’s option, that part of the Equipment that has become defective and will cover reasonable labor cost within the corresponding warranty period of time. M/S Truspact shall bear all reasonable labor costs in connection with the installation of these replacement parts; provided that, the installation is conducted by M/S Truspact or its authorized representative. In case M/S Truspact deems the equipment non-repairable, said equipment will be replaced and the replacement unit(s) will carry the same warranty period from the original unit’s installation date (original Warranty commencement date).
